1 General
1.1. These Terms and Conditions apply to offers, orders and agreements from GPworld. By entering into an agreement between the customer and GPworld according to the procedure as described in these Terms and Conditions, the customer accepts these conditions. GPworld registered with the Chamber of Commerce in Breda with registration number: 20113172
1.2. All rights and claims, as stipulated in these Terms and Conditions, and in any further agreements concluded for the benefit of GPworld, are equally stipulated for the benefit of intermediaries and other third parties engaged by GPworld.
1.3. Deviations from these Terms and Conditions are only valid if they have been agreed in writing with GPworld.
1.4. GPworld has the right to change these Terms and Conditions and the content of the GPworld website.
2 Offers and agreements
2.1. All offers made on the GPworld website are non-binding, even if they contain a period of acceptance. GPworld reserves the right to withdraw offers. All offers are subject to availability. Price changes are reserved. Delivery times and stock are stated as accurately as possible. When a delivery time is unknown from the manufacturer, this will also be stated with the article. Pre-orders can be placed but information about delivery times may therefore not be available. GPworld cannot be held liable for incorrect product information or expected delivery times of products as GPworld is also dependent on information from third parties.
2.2. An agreement between GPworld and the customer is concluded after the customer: has placed an order, by completely filling out the order form on the GPworld website; the customer then clicking on the 'Order' icon on the GPworld website; the customer subsequently confirming that the data provided by the customer is correct and having the customer's order processed, by clicking on the 'Order' icon on the GPworld website, whereupon GPworld has received confirmation at the customer's email address that GPworld has received the customer's order (the receipt confirmation). Reservations (pre-orders) are only accepted by GPworld if payment has been received by GPworld. Without payment, the customer has not made a valid reservation. On the website under your account you can view the current order yourself, including status whether payment has been received.
2.3. GPworld's administration serves, unless proven otherwise, as proof of the orders given by the customer to GPworld and payments made and of deliveries made by GPworld. GPworld recognizes that electronic communication can serve as evidence. By accepting the Terms and Conditions, the customer also acknowledges this.
3 Prices/rates and payment
3.1. All prices for the offered items are in EUROS and include VAT. For orders in the Netherlands, a contribution to handling and shipping costs of EUR 5.75 per order is charged, unless otherwise stated or agreed in writing. For deliveries outside the Netherlands (within Europe) a rate of EUR 8.00 applies. For deliveries outside Europe, price agreements are made.
3.2. In case of non-compliance by the customer with what has been agreed regarding payment, GPworld is entitled to dissolve the agreement with immediate effect extrajudicially or to suspend its obligations, as well as entitled to refuse the customer access to the GPworld system without giving reasons.
4 Delivery/shipping terms
4.1. Deliveries only take place within the Netherlands and within Europe, unless otherwise indicated on the GPworld website or unless otherwise agreed with GPworld.
4.2. The shipping time is normally a maximum of ten (10) working days after receipt of the order (for items available from stock), unless otherwise indicated on the GPworld website. The shipping times are indicative and not as a fatal deadline.
4.3. The shipping term of the product is a maximum of thirty (30) days. (items available from stock)
4.4. When the agreed shipping term is exceeded by GPworld for any reason, GPworld will immediately notify the customer in writing (via fax, letter or e-mail). In that case, the customer has the authority to dissolve the agreement with GPworld by reporting this in writing (via fax, letter or e-mail) to GPworld.
4.5. Any payments already made by the customer will be refunded to the customer's bank or giro account or PayPal account as soon as possible, but in any case within fourteen (14) working days after GPworld has received the request for dissolution of the agreement mentioned in article 4.4.
4.6. GPworld reserves the right to proceed with partial deliveries to the customer, so that an order is sent in two or more shipments.
4.7 When the customer orders and pays for various items that have yet to be released in one go, the items are collected at GPworld to be sent in one go. If the customer wants to have the items that have already arrived earlier, there is the possibility to pick them up at GPworld or transfer shipping costs.
5 Force majeure and/or special circumstances
5.1. GPworld is not obligated to fulfill any obligation to the customer if it is prevented from doing so as a result of a circumstance that is not due to its fault, nor under law, legal act or prevailing views in traffic for its account.
5.2. Circumstances within the meaning of article 5.1 include, among others, a company breakdown, a disruption in energy or material supply, transport delay, a strike and non-delivery or no longer timely delivery by suppliers.
6 Risk
6.1. The risk during transport of the product ordered by the customer is for GPworld. At the moment of delivery of the product, or the moment that can reasonably be regarded as delivery, the risk of the product transfers to the customer, subject to the liabilities that cannot legally be excluded by GPworld.
7 Intellectual and industrial property rights
7.1. The customer must fully and unconditionally respect all intellectual and industrial property rights that rest on the items delivered by GPworld.
7.2. GPworld does not guarantee that the items delivered to the customer do not infringe any intellectual and/or industrial property right of third parties and accepts no liability in case of any claim by third parties based on the assertion that a item delivered by GPworld infringes any right of a third party.
8 Orders/communication
8.1. GPworld is in no way liable for misunderstandings, damages, delays or unclear receipt of orders and communications as a result of the use of internet or any other means of communication in traffic between the customer and GPworld, or between GPworld and third parties, insofar as relating to the relationship between the customer and GPworld.
8.2 Option to reserve / pre-order on the website for not yet released items is optional, no obligation. We offer this option as a service. Without receipt of payment, the customer has not made valid reservations. Customers who have made an advance payment will always have priority over others with delivery or in case of stock shortages.
8.3 Should an item unfortunately be cancelled by the manufacturer, the full payment will be returned immediately after announcement.
8.4 Once the customer has received notification that the item has arrived and the customer has chosen pickup, the customer is obliged to pick up the item within 2 weeks and make full payment. In consultation, a longer term can be agreed upon in case of force majeure, however without notification from the customer, the ordered item goes into regular sale after 2 weeks without refund of any down payment. When the customer has paid the full amount, the item will always remain available until the customer picks it up.
8.5 If the customer has not yet picked up the item within 2 weeks, the customer can transfer the remaining amount plus euro 5.75 shipping costs within the Netherlands and euro 9.95 shipping costs for Europe, after which GPworld will ship the item.
9 Cooling-off period
9.1A. After the customer has received the product ordered by him/her, ordered from GPworld and available from stock, the customer has the authority to dissolve the underlying agreement with GPworld within seven (7) working days after receipt of this product. The customer does not need to give a reason for this. Shipping costs for return are at the customer's expense. The shipping costs incurred by GPworld will not be reimbursed.
9.1B. After the customer has placed a pre-order for the product ordered by him/her, the customer has the authority to dissolve the underlying agreement with GPworld within seven (7) working days after placing the pre-order. The customer does not need to give a reason for this. After 14 days in consultation, it can be looked at whether GPworld can also still cancel it with the supplier(s).
9.2. If the customer wishes to dissolve the agreement pursuant to article 9.1 of these conditions, the customer must report this in writing (via e-mail, letter or fax) to GPworld. The customer must send the product - after consultation with GPworld - to a return address determined by GPworld. In this case, the customer must bear the costs and risk of shipping.
9.3. If the customer has already made any payments at the time the customer has revoked the agreement with GPworld pursuant to articles 9.1. and 9.2 of these Terms and Conditions, GPworld will refund these payments to the customer within fourteen (14) working days after GPworld has received the product returned by the customer. (excluding shipping costs)
9.4. GPworld reserves the right to refuse returned products or to credit only part of the amount already paid, when there is suspicion that the product has already been opened, used or damaged through the fault of the customer (other than that of GPworld or the supplier of the product).
9.5. If a product is returned that in GPworld's opinion has suffered damage that is due to an act or omission of the customer or otherwise is at the customer's risk, GPworld will notify the customer of this in writing (via fax, letter or e-mail). GPworld has the right to deduct the depreciation of the product as a result of this damage from the amount to be repaid to the customer.
10 Warranties
10.1. There is a warranty on the products delivered by GPworld. This is the warranty as established by the manufacturer on its products. This warranty does not affect the rights of the customer that arise from the law.
11 Complaints
11.1. All complaints related to delivery, quality, nature of the product or any other complaint will be seriously handled by GPworld.
11.2. The customer must make a complaint known to GPworld.
11.3. GPworld will try to resolve the complaint within ten (10) working days. GPworld will notify the customer about this in writing (via fax, letter or e-mail).
12 Personal data
12.1. Personal data entered by the customer will be included in a file. This data will be used for the execution of the customer's order. This data will not be provided to third parties.
12.2. Unless the customer has indicated that the customer does not appreciate this, the customer's data will be included in a central file of GPworld. This data will be used to keep the customer fully up-to-date regarding GPworld's products and services. The processing of the customer's data will be done in accordance with applicable laws and regulations.
12.3. Any credit card data of the customer - such as card number and expiration date - will not be stored by GPworld in any file.
12.4. The customer can, if desired, obtain access to the data that GPworld records about the customer's person in GPworld's file. The customer is entitled to demand changes to the data if this data is not correct.
13 GPworld contact details
13.1. All correspondence based on these Terms and Conditions takes place with GPworld, Sint Bavostraat 78, 4891 CK, Rijsbergen, e-mail [email protected]
14 Miscellaneous
14.1. If the customer provides GPworld with an address in writing, GPworld is entitled to send all orders to that address, until the customer has provided GPworld with a new address.
14.2. GPworld is authorized to use third parties in the execution of the customer's order(s). (GLS transport)
15 Applicable law and dispute resolution
15.1. Dutch law applies to all offers, orders and agreements from GPworld. Disputes between GPworld and the customer will be submitted to the competent Dutch Court in Breda.
16 Copyright
16.1 All photos posted on the website and on social media by GPworld may not be used for other commercial purposes without written permission from GPworld.
